ORDINANCE NO. 09-103

An Ordinance adding Chapter 10-114 Traffic and Motor Vehicles.

WHEREAS, the City Council of the City of Oregon has received complaints from citizens concerning vehicle operators using engine braking, compression braking or mechanical exhaust to slow their vehicles upon entering the corporate limits; and

Be it ordained by the City Council of the City of Oregon, Ogle County, Illinois, as follows:

A.It shall be unlawful of the operator of any vehicle to use or permit the use within the City limits of Oregon of any engine brake, compression brake or mechanical exhaust designed to aid in the braking of the vehicle which creates any noise which is audible by a person of normal hearing capability at a distance of three hundred feet (300).

B.It shall be affirmative defense that the person operating, or causing to be used or operated such, mechanical exhaust device in circumstances where it was necessary to avoid injury or an accident.

C.Any person, firm, or corporation found guilty of violating the provisions of this ordinance shall, upon conviction, be fined $75.00.

This ordinance shall be in full force and effect from the date after its passage.
